MONTGOMERY COUNTY REVENUE AUTHORITY PARTICIPATION AGREEMENT FOR MINOR DURING COVID-19 PANDEMIC

ASSUMPTION OF RISK, RELEASE FROM LIABILITY, AND INDEMNIFICATION

This Participation Agreement/Assumption of Risk, Liability Release, and Indemnification (the “Agreement”) has been acknowledged by the Parent or Guardian of the Minor being electronically registered as a condition for the participation of said minor in MCG Junior Summer Camps (the “Activity”) organized by the Montgomery County Revenue Authority (“MCRA”) during the COVID-19 Pandemic.

NOTICE TO PARENTS/GUARDIANS OF MINOR (if participant is 17 years of age or younger): THIS IS A LEGALLY BINDING AGREEMENT. Please read (and if age appropriate, help your child read) this document carefully and understand that by acknowledging this Agreement you give up your right and your child’s right to bring a court action to recover compensation or obtain any other remedy for any injury to you or your child’s person or property, however caused, arising out of your child’s participation in the Activity, now or at any time in the future.

COVID-19: COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is spread mainly from person-to-person contact. MCRA has created new protocols and put in place preventative measures to reduce the spread of COVID-19; however, MCRA cannot guarantee that your child(ren) will not become infected with COVID-19. Further, attending the Activity may increase the risk of contracting COVID-19 to you, your minor child, and those in close contact with you and your child.

PARENT/GUARDIAN’S REPRESENTATIONS CONCERNING CHILD AND FAMILY’S HEALTH AND EXPOSURE TO COVID-19

As parent/guardian of the minor child, I verify that neither I nor my child has any underlying health condition making me or my child particularly vulnerable to COVID-19, that neither I nor my child is showing any symptoms of COVID-19, including cough, shortness of breath or difficulty breathing, or at least two of the following: fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, new loss of taste or smell. I authorize MCRA to take the temperature of my child at any time present for the Activity. I accept, agree and acknowledge that if my child develops the above-referenced Covid symptoms during the Activity, or I or my child or anyone in the child’s household tests positive for COVID-19, my child will not be able to participate in the Activity.

I accept that if required by the Governor’s Orders, my child must be quarantined if he or she has traveled outside the State of Maryland during the last fourteen (14) days or does so during the Activity and that MCRA may deny my child’s participation in the activity pending the quarantine.

ACKNOWLEDGMENT AND ASSUMPTION OF RISK

By acknowledging this Participation Agreement for my child, I hereby agree that:

I understand and appreciate the extremely contagious nature of COVID-19, which is spread mainly from person-to-person contact. I fully understand the risk of my child and me becoming exposed to, or infected by, Covid 19 as a result of the actions, omissions, or negligence of me, my child, and other persons including, but not limited to, MCRA employees, volunteers, Activity participants and their families. I fully understand the risk of exposure and infection resulting from the acts, omissions and negligence of persons picking up, dropping off, working at, or otherwise participating in the Activity.

As parent/guardian of my minor child, I knowingly and voluntarily assume the risk of exposure and infection of COVID-19 to my child, me, and my family as a result of my child’s participation in the Activity. I fully understand that exposure to, and infection by Covid 19, may result in personal injury, illness, permanent disability, and death.

I will wear and provide my child with an appropriately fitting facemask for use during the Activity which must be worn as directed and practicable while participating in the Activity, and that neither I nor my child will be permitted to participate in the Activity if not wearing a facemask when practicable.

I fully understand and appreciate that participation by my child in the Activity involves certain other risks, including the possibility of personal injury, mental or emotional injury, illness, permanent disability, and death.

I fully understand and appreciate the risk to my child from participation in the Activity and, accept sole responsibility for any injury to me or my child, including personal injury, disability, illness, death, damage, loss, claim, liability, or expense, of any kind, that my child or I may experience or incur in connection with my child’s participation in the Activity.

I accept the risk that the Activity could be terminated by MCRA at any time based on a person experiencing COVID-19 symptoms, including a combination of cough, shortness of breath, difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, new loss of taste or smell, or testing positive for COVID-19; and

In order to minimize risk to my child, me and others, I understand that my child and I must abide by any instructions provided in connection with the Activity described above.

RELEASE, INDEMNIFICATION, AND COVENANT NOT TO SUE

In consideration of MCRA’s acceptance of the registration of my child to participate in the Activity, I, the undersigned parent/guardian, hereby knowingly and voluntarily agree, on behalf of my child, myself, and our heirs, successors, representatives, executors, administrators, and assigns, to:

ASSUME RESPONSIBILITY for all risks of liability, loss, claim, damage, or injury (including illness, permanent disability, death, or other serious bodily injury) of any kind that may be sustained by my child, me or the property of my child or me, which may arise out of, result from, or be associated with, my child’s participation in the Activity, whether arising from the negligence of MCRA or other released parties;
RELEASE AND FOREVER DISCHARGE MCRA, its officers, employees, agents, or representatives (hereinafter referred to as “released parties”) from any cause of action, claims, or demands of any nature whatsoever, including but not limited to claims of negligence, for personal injury (including illness, disability and death), property damage, or any other loss whatsoever arising out of, or in any way related to my child’s participation in the Activity, however the injury or damage is caused; and
INDEMNIFY AND HOLD HARMLESS MCRA and other released parties from any and all causes of action, claims, demands, losses, or costs of any nature whatsoever arising out of, or in any way related to, my child’s participation in the Activity.

MCG Academy Golf Camps

Policies and Procedures for Enrollment in Camps

All enrollment in any MCG camps must adhere to the policies

Pick up and Drop off- All parents and students must wear a face-covering during drop off, registration, and pick up for any MCG Camp.

The health questionnaire and liability waiver must be brought to the class on the first day of camp to participate. Campers will not be able to participate without these completed documents.

As per State requirements, daily temperature checks of camp staff and students will be conducted upon arrival. Anyone with a temperature higher than CDC requirements or 100.4 will not be permitted to participate for the remainder of the camp. These temperatures will be recorded daily on the health questionnaire sheet brought on the first day.

Juniors will be required to bring a properly fitting face covering. Face covering must be worn during drop off, registration and pick up. Juniors will not be required to wear masks while hitting golf balls or while playing on the course.

Hot lunches will be provided each day for the Advanced Camp. Pre-packaged chips and a bottle of water will be provided.

Due to COVID restrictions, there is no drinking water on the courses. Campers should come with a sport water bottle which they will be allowed to refill throughout the day.

Due to COVID restrictions, MCG cannot store or hold items. Juniors will be required to carry all items with them for the day.

Arrival - No students will be allowed to be dropped off more than 10 minutes before the designated class time. Face coverings must be worn

Departure - All students must be picked up promptly at the end of the class. Class departure will be located near each MCG parking lot, and parents will wait in their cars until your child is located for pickup. Face coverings must be worn

We will adhere to State guidelines and not exceed 8 students to 1 instructor. Class sizes may increase if the State guidelines change.

As per State requirements, out of state juniors will not be allowed to participate in these classes.

All activities will adhere to strict social distancing policies.

All students will be required to wash their hands before and after lunch.

I understand that if my child is NOT able to adhere to COVID requirements regarding wearing face-covering and social distancing, they will not be able allowed to attend the remainder of the camp.

In the event of inclement weather, a decision on cancellation of the class will be communicated at least 60 minutes prior to the start time. All code red days due to weather will result in cancellation.

We do our best to provide class every day, but sometimes Mother Nature will not allow us to have a class safely. If a class is cancelled due to bad weather, it will not be refunded. If 2 or more classes are cancelled a refund will be issued for classes canceled. Make up classes are not available.

All students are required to bring their own equipment, NO equipment is provided by MCG.
